[ARCHIVED] Southampton Village Elections Postponed to September 15th

VILLAGE OF SOUTHAMPTON - 2020 VILLAGE ELECTION SCHEDULE:

NY State Executive Order 202.26 says “Any Village election previously scheduled to be held in March, April, May, or June will be held on September 15, 2020”. There is no exception in the Executive Order.

MAY 15
First day for Village Administrator to accept applications for absentee ballots. Sec. 15-120, Sub. 4, Election Law. Note: no earlier than four months prior to election.

JUNE 30
First day upon which individual may sign independent nominating petition. Sec. 15-108, Sub. 9, Election Law. Note: no earlier than 6 weeks prior to last date of filing independent nominating petition.

JULY 17
Last day for Board of Trustees to adopt a resolution stating the polling place in each district and the hours during which the polls will be open which shall include at least the hours from 12:00 noon until 9:00 PM. Sec. 15-104 (3), Election Law. Note: at least 60 days prior to election.

JULY 27
First day to file independent nominating petition.  Sec. 15-108, Sub. 8 (a), Election Law. Note: not earlier than 42 days before Village election.

AUGUST 6
Last day for Board of Trustees to appoint inspectors of election. Sec. 15-116, Sub. 1, Election Law. Note: at least 40 days before General Village election.

JULY 30
Last day to file independent nominating petition for an office to be filled at the General Village election.  Sec. 15-108, Sub. 8 (a), Election Law. Note: not later than 35 days before Village election. Note: Upon filing a certificate of nomination or a petition nominating a person, the Village Clerk shall mail notice thereof to each person. Such notice shall state the last day to decline and include a statement that the candidate’s name shall appear on the ballot as it appears in such notice. Sec 6-144, Election Law.

August 14
First Filing of statement of campaign receipts and expenditures for Village election. Secs. 6200.1 and 6200.2, Rules and Reg. of State Board of Elections Of New York.  Note: must be 32 days before election.

AUGUST 14
Last day to file certificate of acceptance or declination of an independent nomination for an office to be filled at the General Village election. Sec. 15-108, Sub. 8 (b), Election Law. Note: not later than 3 days after last day to file the petition.

AUGUST 17
Last day to file certificate to fill vacancy caused by declination of an independent nomination for an office to be filled at the General Village election.  Sec. 15-108, Sub. 8 (c), Election Law. Note: not later than 3 days after the last day to file a certificate of declination.

SEPTEMBER 4
Second filing of statement of campaign receipts and expenditures for Village election.  Secs. 6200.1 and 6200.2, Rules and Reg. of State Board of Elections of New York. Note:  must be 11 days before election.

SEPTEMBER 4
Last day to register with Suffolk County Board of Elections to be eligible to vote in Village election.  Sec. 15-118, Sub. 2, Election Law. Note: At least 10 days prior to election. Where 10 days prior to election falls on day County Board of Elections is closed, then immediate date prior to closure is last day to register. There is no extension for voter registration under Election Law Section 1-106.

SEPTEMBER 5  
Last day for Village Administrator to publish notice stating: 1) polling place in each district, 2) hours during which polls are open (at least noon to 9:00 PM, 3) names and addresses of candidates, offices and term nominated for, and 4) abstract of any proposition.  Sec. 15-104, Sub. 3 (c) and 4, Election Law.
Note: at least 10 days prior to General Village election.  Such notice must also be posted in at least 6 conspicuous places in the Village and at each polling place at least one day before election. Election Law § 1-106 does NOT extend deadlines for Village Clerks or Boards of Trustees when a deadline falls on a Saturday, Sunday, or public holiday since the Village may conduct business on those days.

SEPTEMBER 8  
Last day for Board of Elections to provide a list of registered voters to the Village Administrator. Sec. 5-612, Sub. 1, Election Law.   Note:  at least 7 days prior to General Village election.

SEPTEMBER 8 
Last day for Village Administrator to receive application for absentee ballot which is to be mailed to a qualified voter.  Sec. 15-120, Sub. 5, Election Law. Note:  at least 7 days prior to election.

SEPTEMBER 9
Last day for Village Administrator to mail absentee ballot to qualified voters.  Sec. 15-120, Sub. 56, Election Law. Note: not later than 6 days before General Village election, but see General Construction Law note on last page.

SEPTEMBER 10
Sample ballots must be made available for public inspection not later than this day. Sec. 7-128, Sub. 1, Election Law. Note: Not later than five (5) days prior to the election. Though not required, best practice is to make the sample ballot available for public inspection before sending out absentee ballots.

SEPTEMBER 14 
Last day for Village Administrator to receive personal application for absentee ballot, from applicant or his agent. Upon application, the Village Administrator shall deliver such absentee ballot for a qualified applicant to the applicant or his agent named in such application. Sec. 15-120, Sub. 5, Election Law. Note: not later than 1 day prior to election.

SEPTEMBER 14   
Last day to post notice. Must post notice of election in six conspicuous places in the Village and at each polling place. Sec. 15-104(4) Election Law.

SEPTEMBER 15
Date for delivery by Village Administrator to the Board of Inspectors of absentee ballots. Sec. 15-120, Sub. 8, Election Law. Note: on the day of the General Village election. (Last day for Village Administrator to receive absentee ballots in person or by mail.)

SEPTEMBER 15
Date of General Village election.  Section 15-104, Sub. 1 (a), Election Law.

SEPTEMBER 16
Inspectors must file a certificate of canvass of voters with the Village Clerk. Election Law § 15-126(1). Note: Before 9:00 a.m. of the day following the Village election.

SEPTEMBER 17  
The last day a re-canvass of the vote may be requested. Election Law § 15-126(3).

Note: Not later than two (2) days after the date of the election. The Clerk may, upon his or her own volition, and MUST, upon the written request of any candidate, cause a re-canvass of the votes cast in the Village election. Within one (1) day of receiving a written request, the Village Clerk must notify the County Board of the request for a re-canvass (Election Law § 15-126(3)). 

SEPTEMBER 18  
Last day for Village Administrator to notify the persons that they have been elected and must take an Oath of Office within 30 days after they take office. Sec. 15-128, Election Law. Note: within 3 days after General Village election.

OCTOBER 12 
Third filing of statement of campaign receipts and expenditures for Village elections.  Secs. 6200.1 and 6200.2, Rules and Reg. of State Board of Elections of New York. Note: must be 27 days after election.

* As of 6/19/20 there is no process in place for petitioning. We are awaiting an executive order to set forth a process on how people can get on the ballot for the Village Election.
